米ファイザー、消炎鎮痛剤の健康被害訴訟で和解 総額900億円

 【シカゴ=毛利靖子】製薬世界最大手の米ファイザーは17日、消炎鎮痛剤の副作用で健康被害を受けたとして患者などから訴えられていた問題につい て、原告側の大半と和解したと発表した。和解金の総額は8億9400万ドル(約900億円)にのぼる見込み。6億4000万ドルの関連費用(税引き後)を 2008年7―9月期決算で損失処理する。

 対象は消炎鎮痛剤のベクストラとセレブレックスを巡る訴訟。患者からは服用に伴う副作用で心臓発作になったなどという理由で、また州政府からは宣伝販売方法に問題があったとの訴訟を起こされていた。

 同社はベクストラの販売を05年に中止し、セレブレックスについては「適切に服用すれば効果がリスクを上回る」として、説明書に警告を記載したうえで販売を続けている。和解金の大半は保険金の受け取りで補える見込みだ。 (13:40)

 【ニューヨーク17日時事】米医薬品大手ファイザーは17日、同社の消炎鎮痛剤「セレブレックス」と「ベクストラ」に心臓発作を引き起こす副作用があるなどとされた訴訟で、原告側と暫定和解したと発表した。和解金は総額8億9400万ドル(約903億円)。
 3件の訴訟について和解したもので、(1)身体障害に関する訴訟で7億4500万ドル(2)米33州とコロンビア特別区の司法長官らが起こしていたベク ストラの販売促進に絡んだ訴訟で6000万ドル(3)セレブレックスとベクストラの販促に絡んで消費者らをだましたとする集団訴訟で8900万ドル−の和 解金がそれぞれ原告側に支払われる見通し。ルイジアナ、ミシシッピ両州が起こした訴訟はなお係争中。

Pfizer Reaches Agreements in Principle to Resolve Litigation Involving Its NSAID Pain Medications

Pfizer Inc announced today that it has reached agreements in principle to resolve substantially all of the personal injury cases, consumer fraud cases and state attorneys general claims involving its non-steroidal anti-inflammatory (NSAID 非ステロイド性抗炎症薬) pain medication Bextra, which Pfizer voluntarily withdrew from the U.S. market in 2005. Additionally, following key court rulings in favor of Celebrex, claims regarding Celebrex, an effective pain treatment for millions of patients, will also be resolved as part of the settlement.

 米国食品医薬品局(FDA)は4月7日、選択的COX2阻害薬であるBextra (成分名:valdecoxib)の販売停止を、製造元の米Pfizer社に要請した。心血管疾患リスクや中毒性表皮壊死症のような皮膚に関する重篤な副 作用のリスクが、他の非ステロイド性消炎鎮痛薬(NSAID)と比べて高く、またBextraならではの優位性にも欠けることが理由という。米 Pfizer社は、この要請を受け入れた。

 FDAは、同社のCOX2阻害薬であるCelebrex (成分名:celecoxib)や、その他の処方薬のNSAIDについては、注意書きを改め、心血管疾患リスクや胃腸出血に関する記述を強調し、またそれ らのリスクに関して患者の理解を促す「Medication Guide」(メディケイション・ガイド)を加えるよう求めた。

 昨年9月 に既に販売停止を決めたVioxx (rofecoxib)については、FDAは今後、製造元の米Merck社から販売の再開に関する提案があれば、それを注意深く再調査していく、としてい る。さらに一般用医薬品(OTC)のNSAIDについても、製造元に対し、心血管疾患リスクと胃腸出血の副作用に関して、消費者により明確な情報を提供す る表示に変えるよう要請した。

 リウマチは、手足などの関節が破壊され、痛む病気だ。痛みには、細胞内で作られるシクロオキシゲナーゼ(COX)と呼ばれる酵素が関係しており、NSAIDはこの酵素の働きを妨げて痛みや炎症を抑える薬だ。

 COXには、胃腸の粘膜を守るCOX1と、炎症を促すCOX2の2種類がある。NSAIDの多くは、両方の働きを抑えるので、胃腸が荒れやすくなる副作用が表れる。胃に穴が開いて出血し、死亡した患者もいる。

 そこで、痛みに関係するCOX2だけを狙う「COX2阻害薬」が開発された。胃かいようの発生率が従来の薬に比べ半分ほどに減った。

 しかし、新たな副作用が問題化したのだ。

 この薬の一つ、ロフェコキシブ(商品名バイオックス)を飲んだ患者は、一般的なNSAIDの服用者に比べ、約4倍も多く心筋梗塞(こうそく)を起こしたことが、2000年に米国で発表された。その後も同様の研究が相次ぎ、製薬企業米メルクは昨年9月、自主回収に追い込まれた。

 同じくセレコキシブ(同セレブレックス)、バルデコキシブ(同ベクストラ)についても、米政府は昨年12月、「心筋梗塞や脳梗塞の危険性を高める 恐れがある」として、心臓病患者への処方や多量の長期使用を避けるよう勧告した。ただし、3剤とも「服用による利益は危険性を上回る」として、販売継続は 認める方針で、近く最終結論を出す予定だ。

 

『バイオックス』VIOX 分類:医薬品

  米医薬品大手メルクの関節炎治療薬。アスピリンと比較して効果が高いためスーパーアスピリンと呼ばれています。90年代大手製薬会社が莫大な資金を投じて、COX2選択的阻害剤(アスピリンはCOX1と2両方に作用するため副作用が生じます。詳しくは関連サイト参照。)の開発が行われ、例えばメルクはこのバイオックス、ファイザーはセレブレクス、べクストラという医薬品を誕生させました。それ以来、これらの医薬品は製薬会社に多大な利益をもたらしました。(メルクに関しては売り上げの10%を占めていました(2003年)。)

 しかし、バイオックスは心臓発作の危険を増大させる恐れがあるとして、メルクは2004年に自主回収に追い込まれました。その後、2005年2月に米食品医薬品局(FDA)に より、「販売しても問題ない安全性を備えている」との結論が出されましたが、実際、2005年8月、バイオックスを用いて死亡した遺族による訴訟により、 死亡したのは副作用のリスクを隠していた製薬会社側の過失だとして、遺族に280億円の支払いを命じる判決がでました。現在、バイオックスの副作用に関す る訴訟は約4200件ほどあります。

大型薬自主回収にみる製薬会社の危機管理

 9月30日早朝、製薬業界と金融市場に激震が走った。製薬大手メルクが、心臓発作などの危険性を高める可能性があるとして、関節炎などの治療薬「バイ オックス(Vioxx)」の販売中止と、全世界での自主回収を発表したためだ。バイオックスは年間25億ドルを売上げ、米国だけで患者が2000万人に達 するという大型薬。医師や患者への副作用警告に留まらず、即座に自主回収に踏み切ったとする同社の対応は、「製薬会社の危機管理の見本」として各方面から 高い評価を得た。



―自主回収までの道のり

 バイオックス服用による心血管リスク上昇は、バイオックスが発売された1999年当時から問題視されていた。メルクも2000年6月、「ナプロキセン」 と呼ばれる抗炎症薬と比較した臨床試験で、バイオックス投与群で心血管疾患発症の危険性が高かったとの結果をFDAに報告。だが、発症率の違いはナプロキ センに心血管保護効果があるためであるとして、バイオックスと心血管リスク上昇の因果関係を否定した。その後も、外部研究者らが危険性調査に目的を絞った 試験の実施を要求してきたが、メルクは同じ主張を繰り返してこれらをかわして来た。

  メルクによると、自主回収は「アプルーブ」と呼ばれる臨床試験の結果、バイオックス投与群で偽薬投与群に比べて心血管障害の危険性を高める兆候が確認され たことがきっかけだった。FDAなどの資料によると、メルク研究開発部門の責任者が、アプルーブ関係者から試験中止とバイオックス投与中止勧告を受けたの が9月23日夕刻。翌日午前にはギルマーチン最高経営責任者(CEO)に報告され、研究員らがアプルーブ試験結果の分析を開始、勧告内容の正当性を確認し た。その後、経営陣が外部専門家らの意見を聞きながら対応を協議し、27日に販売中止を決定。翌28日にメルク取締役会が全会一致でこれを承認し、FDA に報告。決定は危機管理担当者とPR担当者らに順次通達され、30日午前9時、ギルマーチンCEOが会見を行い、販売中止と自主回収を発表した。


―危機管理の見本

 メルクの自主回収の発表は当初、PR関係者らから「危機管理の見本」として高く評価された。危険性の兆候が報告されてから発表まで1週間という迅速な対 応はもちろんのこと、この間に外部に情報が漏れた形跡がほとんどなかったためだ。仮に外部に情報が漏れ、これが報道されたり、またFDAなどから回収を命 令されたりといった事態に発展すると、すでに自主回収に向けて準備を進めていたとはいえ、企業イメージが被るダメージは一層大きくなっていたはずだ。

  メルクは、近くFDA承認が期待される同じ種類の新薬を抱えており、新薬販売への影響を最小限に抑える必要があった。発表の朝、ギルマーチンCEOが自ら テレビ画面に登場し、「患者のことを最優先して自主回収に踏み切った」と語った効果は小さくない。また、ホームページの一番目立つ場所にバイオックス関連 コーナーを開設し、CEOや研究開発責任者のメッセージ、背景説明、試験結果、患者への払い戻し案内といった情報提供にも努めている。


―先手必勝のPR

 メルクの発表後、11月には社内文書やFDA内部文書などから、メルクが数年前から危険性を認識していたにもかかわらず、関係者に圧力をかけるなどし て、それを隠匿していたとの疑いが浮上。予期されていたことではあるが、株価は9月から40%も下落し、バイオックスに関する訴訟件数は10月末時点で 375件に達した。米司法省や米証券取引委員会(SEC)も調査を開始するなど、メルクにとって苦しい状況が続いている。

  内部文書漏洩に先立つ10月末、メルクは訴訟に備えて自発的に準備した資料の一部が不当に持ち出され、「文脈を無視して誤って解釈される可能性がある」と の警告を発表し、報道に先手を打って防衛線をはっていた。また、医学専門家による批判には、過去の試験結果を引用して反論。一般消費者には、新聞広告など を利用し「危険性判明後は正しい行動を迅速にとった」などとする自らの正当性を訴えるメッセージを発信している。

一方、バイオックスと同 種の治療薬を販売するファイザーは、メルクの販売中止の翌日には、ファイザー製品には心臓疾患を起こす危険性を示す兆候はないと発表。また、危険性の有無 を調査するために大規模臨床試験実施の方針を新たに打ち出すなど、飛び火を防ぐためのPR活動に力を入れている。

【11月10日 AFP】米医薬大手メルク(Merck)は9日、鎮痛剤「バイオックス(Vioxx)」の副作用に関する訴訟で、和解金48億5000万ドル(約5365億円)を支払うことで原告側の大半と和解の合意に至ったと発表した。

 一方で同社は同和解について、責任を認めるものではないとの見解も同時に示している。

 9日付の米大手経済紙ウォールストリート・ジャーナル(Wall Street Journal)によると、メルクはこれまで、2万7000件以上の訴訟すべてに対し法廷で争う構えを見せていたという。

 2004年に心臓発作のリスクを高めるとの副作用が確認されたため、メルクは同鎮痛剤を市場から回収している。(c)AFP

Key Rulings in Favor of Celebrex Set Stage for Personal Injury Settlements

Todays announcement follows favorable rulings in which federal and New York state court judges overseeing a majority of the personal injury cases ruled that the plaintiffslawyers failed to present reliable scientific evidence to prove Celebrex can cause heart attacks or strokes at its most commonly prescribed dose. These rulings would have likely limited the scope of these cases had the litigation continued. By settling these matters now, the parties are minimizing the future cost and disruption inevitably associated with litigation.

These rulings within the past year are consistent with the conclusion reached by the U.S. Food and Drug Administration (FDA) in 2005 that, based on the available data, the benefits of Celebrex outweigh its risks for appropriate patients at approved doses. The FDA requires that all prescription NSAIDs carry the same cardiovascular boxed warnings.

Settlements Resolve Substantial Litigation

The personal injury settlements will resolve more than 90 percent of the known personal injury claims brought by law firms representing persons who allege that Pfizers NSAID pain medications were the cause of a heart attack, stroke or other injury. Pfizer will work to finalize agreements with each of the law firms with which it has agreements in principle before the end of the year.

Pfizer also has reached an agreement in principle to settle payor class action consumer fraud cases involving Bextra and Celebrex in which plaintiffs allege economic loss relating to the promotion of these medications. The settlement will resolve these cases on a nationwide basis and is subject to approval by the appropriate courts.

In addition, Pfizer has reached agreements in principle to resolve claims brought by 33 states and the District of Columbia, primarily relating to alleged Bextra promotional practices. Under these settlements, Pfizer will make a total payment of $60 million to the states and adopt compliance measures that complement policies and procedures previously established by the company.

Pfizer has insurance coverage for a portion of the personal injury settlements and is seeking to recover payments to which it believes it is entitled from its insurance carriers.

Pfizer will reflect these significant, non-recurring items as a third quarter pre-tax charge of $894 million ($640 million after-tax) to reported earnings. The charge includes amounts of (i) $745 million applicable to personal injury claims, which Pfizer believes will be sufficient to resolve the remaining pending personal injury claims, (ii) $60 million applicable to state attorneys general settlements and (iii) $89 million applicable to consumer fraud class action claims.

The agreements in principle that we are announcing today enable us to focus on what is core to our business ? providing innovative medicines to treat patients suffering from some of the worlds most widespread and debilitating diseases,Ms. Schulman said.

Pfizer Inc said on Friday it plans to pay $894 million to settle lawsuits alleging that its withdrawn Bextra painkiller and widely used Celebrex arthritis drug harmed U.S. patients and defrauded consumers.

Pfizer said the money would be paid out under three separate tentative settlements -- including one that resolves claims by 33 states and the District of Columbia primarily related to Bextra marketing practices.

"It's good that Pfizer is settling the majority of these cases because these things tend to drag on for five to 10 years and take a lot of focus off running the company," said Jon LeCroy, an analyst with Natixis Bleichroeder.

LeCroy said Wall Street has closely followed the Bextra and Celebrex cases because Bextra was sold only briefly. Moreover, he said Celebrex has not been shown to have the same cardiovascular risks as Vioxx, a similar drug that Merck & Co Inc withdrew in 2004.

New York-based Pfizer said it has taken a pretax charge of $894 million in the third quarter for the proposed settlements, and that the funds should also be sufficient to cover personal injury cases that have not yet been resolved.

The company, which still sells Celebrex, said it decided to settle to eliminate the legal distractions, although it admitted no wrongdoing.

"Putting all these matters behind Pfizer makes good sense from the company point of view and with respect to patients and doctors," Amy Schulman, Pfizer's general counsel, said in an interview.

The charge includes $745 million to resolve personal injury claims, $60 million to settle with the states over Bextra marketing practices and $89 million to resolve consumer fraud class-action cases that allege Bextra and Celebrex promotions caused financial harm.

Bextra and Celebrex belong to the same class of painkillers as Vioxx, which was withdrawn after being linked to heart attacks among long-time users. Merck has resolved claims from most of the thousands of U.S. patients who said they were harmed by its drug with a $4.85 billion settlement.

In 2005, the U.S. Food and Drug Administration asked Pfizer to withdraw Bextra from U.S. drugstores, citing a possible risk of causing heart problems and reports of a potentially fatal skin reaction called Stevens-Johnson syndrome in people taking the drug.

Pfizer's Schulman declined to break down how much of the money being set aside would satisfy Bextra claims or Celebrex lawsuits.

But she said federal and state courts have ruled there is no reliable scientific evidence that Celebrex increases risk of heart attack and stroke.

At the time that Bextra was withdrawn, the FDA ordered that all prescription nonsteroidal anti-inflammatory drugs (NSAIDs), including Celebrex, carry a "black box" warning about potential increased risk of heart attacks, strokes and stomach problems.

The FDA also required that all over-the-counter NSAIDs, including naproxen and ibuprofen, include more information about those risks, as well as the risk of serious skin reactions. The label changes do not apply, however, to aspirin or acetaminophen -- the active ingredient of Johnson & Johnson's Tylenol painkiller.

Pfizer shares were down 3 cents to $16.94 on the New York Stock Exchange on Friday.


Product Litigation

Celebrex and Bextra
In 2003, several purported class action complaints were filed in the U.S. District Court for the District of New Jersey against Pharmacia, Pfizer and certain former officers of Pharmacia. The complaints allege that the defendants violated federal securities laws by
misrepresenting the data from a study concerning the gastrointestinal 胃腸 effects of Celebrex. These cases were consolidated for pre-trial proceedings in the District of New Jersey (Alaska Electrical Pension Fund et al. v. Pharmacia Corporation et al.). In January 2007, the court certified a class consisting of all persons who purchased Pharmacia securities from April 17, 2000 through February 6, 2001 and were damaged as a result of the decline in the price of Pharmacias securities allegedly attributable to the misrepresentations. Plaintiffs seek damages in an unspecified amount. In October 2007, the court granted defendantsmotion for summary judgment and dismissed the plaintiffsclaims in their entirety. In November 2007, the plaintiffs appealed the decision to the U.S. Court of Appeals for the Third Circuit.

Pfizer is a defendant in product liability suits, including purported class actions, in various U.S. federal and state courts and in certain other countries alleging
personal injury as a result of the use of Celebrex and/or Bextra. These suits include a purported class action filed in 2001 in the U.S. District Court for the Eastern District of New York as well as actions that have been filed since late 2004.
In addition, beginning in late 2004, purported class actions have been filed against Pfizer in various U.S. federal and state courts and in certain other countries alleging
consumer fraud as the result of alleged false advertising of Celebrex and Bextra and the withholding of information from the public regarding the alleged safety risks associated with Celebrex and Bextra. The plaintiffs in these consumer fraud actions seek damages in unspecified amounts for economic loss. In September 2005, the U.S. federal product liability and consumer fraud actions were transferred for consolidated pre-trial proceedings to a Multi-District Litigation (In re Celebrex and Bextra Marketing, Sales Practices and Product Liability Litigation MDL-1699) in the U.S. District Court for the Northern District of California. The majority of the cases involving Celebrex are pending in the Multi-District Litigation and in coordinated proceedings in the Supreme Court of the State of New York. In late 2007 and early 2008, the courts in both of those actions ruled that plaintiffs failed to present reliable scientific evidence necessary to prove that Celebrex can cause heart attacks
and strokes at the 200 mg daily dose, which is the most commonly prescribed dose.
These rulings render inadmissible certain opinions of plaintiffsexperts, which we believe could result in the dismissal of many of the Celebrex cases.

In July 2005, an action was filed by the Attorney General of the State of Louisiana in the Civil District Court for Orleans Parish, Louisiana, against Pfizer seeking to recover amounts paid by the Louisiana Medicaid program for Celebrex and Bextra and for medical services to treat persons allegedly injured by Celebrex or Bextra. The action also seeks injunctive relief to prevent the sale of Celebrex and any resumption of the sale of Bextra in Louisiana.
This action was removed to the U.S. District Court for the Eastern District of Louisiana and thereafter transferred for consolidated pre-trial proceedings to the same Multi-District Litigation referred to in the preceding paragraph.

Beginning in late 2004, actions, including purported class and shareholder derivative actions, have been filed in various federal and state courts against Pfizer, Pharmacia and certain current and former officers, directors and employees of Pfizer and Pharmacia.

violated federal securities laws by misrepresenting the safety of Celebrex and Bextra; (ii) purported shareholder derivative actions alleging that certain of Pfizers current and former officers and directors breached fiduciary duties by causing Pfizer to misrepresent the safety of Celebrex and, in certain of the cases, Bextra; and (iii) purported class actions filed by persons who claim to be participants in the Pfizer or Pharmacia Savings Plan alleging that Pfizer and certain current and former officers, directors and employees of Pfizer or, where applicable, Pharmacia and certain former officers, directors and employees of Pharmacia, violated certain provisions of the Employee Retirement Income Security Act of 1974 (ERISA) by selecting and maintaining Pfizer stock as an investment alternative when it allegedly no longer was a suitable or prudent investment option. In June 2005, the federal securities, fiduciary duty and ERISA actions were transferred for consolidated pre-trial proceedings to a Multi-District Litigation (In re Pfizer Inc. Securities, Derivative and ERISALitigation MDL-1688) in the U.S. District Court for the Southern District of New York.

In July 2007, the purported federal shareholder derivative action alleging breach of fiduciary duty was dismissed by the court in the Multi-District Litigation. In August 2007, the plaintiffs appealed the decision to the U.S. Court of Appeals for the Second Circuit.
